U.S. v. Gaitan-Acevedo, No. 95-1616 (6th Cir.) (148 F.3d 577) (May 12, 1998) (Judge Damon J. Keith)

Joining six other Circuits, the Court held that the "indicment or waiver" phrase contained in 21 USC ยง 851(a)(2) refers to the federal offense for which the mandatory sentence is imposed.
