U.S. v. Earnest, No. 98-3020 (7th Cir.) (185 F.3d 808) (July 21, 1999) (Judge Michael S. Kanne)

Here the Court affirmed the district court's findings, on remand, that the defendant was properly sentenced based on crack cocaine, in part because, during trial, the defendant had admitted it was crack and treated that as an effective waiver.
