U.S. v. Hamilton, No. 97-50540 (9th Cir.) (208 F.3d 1165) (March 24, 2000) (Judge Samuel P. King)

In this case, the Court described the notification procedures set forth in 21 U.S.C. ยง 851(a)(1) as "mandatory" and stated that "if the requirement is not satisfied, a court may not enhance a sentence even if a defendant has prior felony drug convictions." (Id., at 1168).
