Bousley v. U.S., No. 96-8516 (U.S. Supreme Court) (523 U.S. 614; 118 S.Ct. 1604) (May 18, 1998) (Justice Rehnquist)

Here the Court held that a petitioner who has procedurally defaulted a Bailey-type claim by failing to raise it on direct appeal can raise it on collateral review by showing cause and actual prejudice or that he is actually innocent of the charges.
