Illinois v. Fisher, No. 03-374 (U.S. Supreme Court) (540 U.S. 544; 124 S.Ct. 1200) (February 23, 2004) (Per Curiam)

Here the Court reaffirmed its rule from Arizona v. Youngblood that , unless a defendant can show bad faith on the part of the police, he cannot establish a violation of his due process rights because the police fail to preserve potentially useful evidence.
