Daniels v. Williams, No. 84-5872 (U.S. Supreme Court) (474 U.S. 327; 106 S.Ct. 662) (January 21, 1986) (Justice Rehnquist)

Here the Court held that where an official's or government entity's constitutes mere negligence, no substantive due process violation occurs. The Court expressly left open the question whether something less than intentional conduct such as recklessness or gross negligence would suffice "to trigger the protections of the Due Process Clause." ...
